ATLANTIC CONSTRUCTION GROUP, INC. ("Company," "we," "our," or "us") provides these Terms and Conditions to govern your access to our website and general contracting services. By signing a construction contract, approving a site plan, or using our project management platforms, you ("Client," "you," or "your") agree to be bound by these Terms and Conditions in their entirety. If you do not agree with any part of these terms, you must not utilize our construction services. These terms constitute a legally binding agreement between you and the Company.
We provide professional general contracting, single-family home construction, structural remodeling, and site management services. All construction projects are executed in strict accordance with approved architectural blueprints, municipal zoning laws, and the Massachusetts State Building Code. We reserve the right to halt construction if site conditions are deemed unsafe or if undisclosed structural or environmental hazards are discovered.
All initial construction estimates and material quotes provided by our firm are valid for 30 days. Initial quotes are based on preliminary site visits and standard material pricing. Final project costs may vary due to fluctuations in lumber or material costs, or hidden site conditions (e.g., ledge rock, poor soil bearing). Any deviations from the original construction contract must be approved through a formal, written "Change Order" signed by both the Client and the Company before additional work proceeds.
Clients are strictly responsible for funding their construction project according to the progress payment schedule outlined in their specific contract (e.g., foundation poured, framing completed, rough-in inspections passed). Failure to make timely payments may result in work stoppage. In accordance with Massachusetts law, the Company reserves the right to place a mechanic's lien on the property for any unpaid labor, materials, or subcontractor services rendered.
Active construction zones are inherently dangerous. The Client agrees not to enter the construction site outside of scheduled, supervised walk-throughs with our project managers. When on-site, the Client must wear appropriate personal protective equipment (PPE) as directed. The Company is not liable for injuries sustained by the Client or their guests due to unauthorized access to the active job site.
While we strive to adhere to the estimated construction timeline, all project completion dates are approximate. The Company shall not be held liable for delays caused by factors beyond our reasonable control, including severe weather conditions, municipal permit backlogs, failed third-party inspections, material supply chain shortages, or labor strikes.
We utilize high-quality building materials suited for residential construction. Manufacturer warranties on specific materials (e.g., roofing shingles, windows, HVAC units) are passed directly to the Client upon project completion. The Company provides a standard one-year workmanship warranty on our direct labor, covering structural integrity and installation defects, subject to proper home maintenance by the Client.
All architectural blueprints, 3D renderings, floor plans, and site topography maps created or provided by ATLANTIC CONSTRUCTION GROUP, INC. remain the exclusive intellectual property of the Company or our partnered architects. These materials are provided solely for the execution of your specific project and may not be reproduced, sold, or used for other construction purposes without our express written permission.
The Company maintains comprehensive general liability and builder’s risk insurance. However, our liability for administrative errors or digital project portal disruptions is limited. We are explicitly not responsible for pre-existing structural defects in remodeling projects that were not visible during the initial estimation phase. To the fullest extent permitted by law, our liability is limited to the direct costs associated with correcting our specific scope of work.

The Client agrees to communicate all project directives, questions, and concerns directly to our assigned project manager or the Company's central office. The Client shall not directly instruct, reprimand, or negotiate with our independent subcontractors, carpenters, or laborers on the job site. Disruptive behavior or interference with site operations may result in contract termination.
These Terms and Conditions and all construction contracts shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. Any legal disputes arising from our general contracting services must be resolved through good faith negotiation. If litigation becomes necessary, both parties consent to the exclusive jurisdiction of the state courts located in Middlesex County, Massachusetts.
You agree to fully indemnify and hold harmless ATLANTIC CONSTRUCTION GROUP, INC., its officers, project managers, and staff from any claims, damages, or liabilities arising from your unauthorized interference on the job site or failure to secure proper funding. If any provision of these Terms is found by a court to be unenforceable, that specific provision shall be limited to the minimum extent necessary so that the remainder of these Terms shall remain in full legal effect.
